This confidentiality policy is applicable from the 29th of June 2018
1.1 This Policy on the protection of personal data (hereinafter the “Policy”) describes AC&B’s practices for gathering, processing and retaining personal data (hereinafter the “Personal Data”) of visitors and users (hereinafter the ”User(s)”) when using and roaming on the romy-paris.fr website and the application provided by AC&B (hereinafter the “Website”), in accordance with the provisions of the consolidated version of Act No. 78-17 of 6 January 1978 on Information Technology, Data Files and Civil Liberties.
1.2 This Policy may be modified, supplemented or updated in order to comply with all legal, editorial or technical developments. The User must refer to it before browsing to the latest updated version of the Policy.
1.3 The Policy is an integral constituent of the General Conditions for Use of the Website.
2. PARTY RESPONSIBLE FOR GATHERING PERSONAL DATA
The party in charge of gathering, processing and retaining the Personal Data is AC&B simplified company limited by shares, with capital of EUR 106,593.00, whose headquarters are at 2 rue Gustave Eiffel, 10430 Rosières près Troyes, and which is registered in the Troyes Commercial Register under number 539 717 629 (hereinafter “AC&B”).
This being the case, AC&B is considered to be the party in charge of processing Personal Data in accordance with Local Regulations. AC&B has appointed an IT and Civil Liberties Correspondent to manage the processing of Personal Data. The IT and Civil Liberties Correspondent will enable AC&B to ensure its compliance with Local Regulations. The IT and Civil Liberties Correspondent will ensure that all necessary precautions have been taken to ensure the security of the Personal Data and, in particular, to prevent them from being distorted or damaged and from being accessed by unauthorised persons. The designation of an IT and Civil Liberties Correspondent demonstrates AC&B’s commitment to respecting the private life and rights of the Users whose Personal Data are processed.
3. USE OF THE PERSONAL DATA
According to the Local Regulations, the User’s Personal Data enable AC&B to provide him with products or services, to offer him products and services that are likely to interest him and to communicate with him for other obvious purposes in the given circumstances, and in relation to which AC&B will inform the User when it gathers his Personal Data.
These include primarily the surnames, first names, dates of birth, email addresses, telephone numbers that enable identification of the User and data that enable use of AC&B’s services, such as geolocation, consumer habits or the diagnostic checks undertaken.
4. NON-DISCLOSURE OF PERSONAL DATA
4.1 The User’s Personal Data may also be passed on to third parties acting on behalf of AC&B or for the account of AC&B in connection with specific processing in accordance with the purposes for which they were initially gathered, or that may be processed legally, in accordance with the Local Regulations, in connection with activities such as the supply of services, assessment of use of the Website, product distribution and marketing, data management and technical support. Such third parties are contractually bound to use the User’s Personal Data only for the agreed purposes, and not to sell or divulge them to other third parties, unless required by law, or if AC&B has explicitly authorised them to do so, or if such arrangements are provided for under this Policy.
4.2 The Personal Data that AC&B gathers may also be communicated to a third party if the activity of all or part of this Website and the associated client data are sold, assigned or transferred, in which case AC&B will require the purchaser or the assignee to process the Personal Data in question in accordance with this Policy. Furthermore, the Personal Data may be divulged to a third party if AC&B is required to do so under a currently valid law or statutory provision, a judicial order or a government regulation, or if the data in question is required to be divulged in connection with an inquiry or criminal proceedings, either nationally or abroad.
5. RIGHT OF ACCESS, CORRECTION AND OPPOSITION
5.1 Whenever AC&B processes Personal Data, it will make every reasonable effort to ensure the accuracy and relevance of the User’s Personal Data based on the purpose for which AC&B gathers the data.
5.2 The User has a right to access, correct and oppose the processing of his Personal Data for legitimate reasons, and may exercise that right by sending an email to the following address: email@example.com
5.3 If canvassing takes place, including electronically, AC&B will provide the User with means to enable him to oppose or consent to receiving information, in accordance with Local Regulations.
5.4 Requests to delete Personal Data will be subject to the obligations imposed on AC&B by law, in particular in relation to the preservation or archiving of documents.
6. SECURITY AND CONFIDENTIALITY
In order to ensure the security and confidentiality of the Personal Data and/or Personal Health Data that AC&B gathers on line, AC&B will use networks that are protected by standard tools such as firewalls and passwords. When processing the User’s Personal Data, AC&B will take all reasonable measures to protect the data against any loss, inappropriate use, unauthorised access, disclosure, alteration or destruction.
A “cookie” is a tiny information file sent by the User’s browser and stored in the User’s computer terminal (hereinafter “Cookies”). This file includes information such as the User’s Internet service provider, the User’s operating system and the date and time of access. Cookies never risk damaging the User’s terminal.
AC&B is likely to gather and process, with third party websites in particular, the User’s information relating to its visit to the Website; such information will include the pages viewed, the research undertaken, the website visited immediately prior to visiting the Website and the choices made by the User as regards services or personalisation. This information will allow AC&B to improve the content of the Website, the User’s browsing experience, and/or to compile statistics relating to those using the Website, in order to study the market internally or provide the User with the service he has requested.
